Terms of Service

By registering for an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these terms. If you do not agree to these Terms, you may not use the Service.

AlgoTell is a cloud-based Customer Relationship Management (CRM) and telecalling platform designed to help businesses manage leads, execute auto-dialing campaigns, track communications, and analyze agent performance. The Service includes software interfaces, API access, and third-party telephony integrations. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time.

• Account Creation: You must provide accurate, complete, and current information when creating your account.
• Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
• Acceptable Use: You agree not to use the Service for any unlawful purpose, to harass or spam individuals, or to violate the rights of any third party.

Given the nature of telecalling, you are strictly responsible for complying with all applicable local, national, and international laws regarding telemarketing and data privacy. This includes, but is not limited to:

• Consent: Obtaining explicit, verifiable consent before calling or sending SMS messages to any individual where required by law (e.g., TCPA, GDPR, TRAI).
• Do Not Call Registries: Respecting national and local "Do Not Call" (DNC) lists and maintaining an internal DNC list within the AlgoTell CRM.
• Call Recording Laws: Ensuring you comply with all wiretapping and eavesdropping laws, including providing audible announcements that a call is being recorded (e.g., one-party vs. two-party consent laws).

Failure to comply with telecom regulations may result in immediate suspension or termination of your account without a refund.

• Subscriptions: The Service is billed on a subscription basis (monthly or annually). You will be billed in advance on a recurring schedule.
• Telephony Usage: Call minutes, SMS segments, and phone number rentals are billed separately or deducted from a prepaid credit balance, depending on your plan.
• Refunds: All fees are non-refundable unless otherwise required by law or explicitly stated in your contract.
• Taxes: You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities based on your usage of the Service.

Your Data: You retain full ownership of all the data, leads, contacts, and recordings you upload or generate using the Service. You grant us a limited license to host, process, and transmit this data solely for the purpose of providing the Service to you.

Our Intellectual Property: AlgoTell, including its software, designs, algorithms, trademarks, and documentation, is the exclusive property of Algorithus Software Pvt Ltd. You may not copy, modify, distribute, or reverse engineer any part of the Service.

You may cancel your subscription at any time via your account settings. We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Sections regarding Intellectual Property, Limitation of Liability, and Governing Law shall survive termination.

To the maximum extent permitted by applicable law, in no event shall Algorithus Software Pvt Ltd, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any unauthorized access, use or alteration of your transmissions or content.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

These Terms shall be governed and construed in accordance with the laws of India, specifically under the jurisdiction of the courts located in Lucknow, Uttar Pradesh, without regard to its conflict of law provisions.
